Welcome to the Circular Arts Network (CAN) platform, operated by Sustainable Arts in Leeds CIC (SAIL.) By accessing or using the CAN platform, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before listing, hiring, selling, giving away, or claiming any items on this platform. If you do not agree to these terms, please do not use the platform.
2. Definitions
- Lister: Any individual or organisation that posts items on the CAN platform for sale, hire, or giveaway.
- Claimer: Any individual or organisation that claims, hires, purchases, or accepts items listed on the CAN platform.
3. Scope of Service
The CAN platform is an online space for individuals to list items for sale, hire, or giveaway. SAIL provides the platform as a free service for the creative community but does not participate in any transactions, nor do we verify, endorse, or take responsibility for any items listed. SAIL is not liable for any issues, disputes, or damages arising from listings, claims, or exchanges of items.
4. Liability and Disclaimer
- SAIL takes no responsibility for the quality, condition, legality, safety, or fitness for purpose of items listed on the CAN platform.
- We do not offer, nor are we responsible for, any insurance or warranties related to listed items.
- All transactions and arrangements for listing, hiring, selling, giving away, or claiming items are solely the responsibility of the parties involved.
- By using the platform, you acknowledge that you use it at your own risk and release SAIL from any liability arising from your use or inability to use the platform.
5. Responsibilities of Listers
- Listers must ensure that any items listed comply with relevant laws and are accurately described to the best of their knowledge.
- If listing an item for hire, listers should verify that the person or organisation hiring the item is adequately insured, particularly for high-value or specialised items.
6. Responsibilities of Claimers
- Claimers are responsible for ensuring that any item they borrow, hire, purchase, or accept is suitable for their intended use.
- It is the responsibility of the claimer to verify that any electrical equipment has been Portable Appliance Tested (PAT) or otherwise certified as safe before use.
- Claimers are encouraged to ensure they have adequate insurance coverage when borrowing or using high-value or specialised items.
7. User Conduct
Users agree not to misuse the platform, including but not limited to:
- Posting fraudulent, unlawful, or misleading information.
- Harassing, intimidating, or threatening other users.
- Using the platform in any way that could harm or impair its functionality for other users.
8. Termination of Use
SAIL reserves the right to suspend or terminate a user’s access to the CAN platform if these terms are violated or at SAIL’s discretion, without prior notice.
9. Changes to Terms and Conditions
SAIL may amend these Terms and Conditions at any time without prior notice. Continued use of the platform constitutes acceptance of any updated terms.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of United Kingdom. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
